General Information
The Aquarius Press/Willow Books websites are the online arms of Aquarius Press, a publishing and digital services company.
Forms of Payment for Book Purchases
In addition to acceptance of checks and money orders, Aquarius Press handles credit card purchases with a secure service. There is a $30 charge on all returned checks. All transactions are secure and no information is shared with 3rd party vendors.
Misprints and Orders
Although Aquarius Press strives to provide reliable and current information, misprints and other errors may occur. Aquarius Press reserves the right to change information on the website at any time and from time to time without any notice or liability to buyers and sellers. Items listed on this website are subject to availability; buyers will be notified if an item is not available..
Order Processing
Buyer orders are considered valid upon completion of the sales transaction with credit/debit card or upon receipt of payment in the form of check or money order via US postal mail to Aquarius Press. Buyer will receive a shipping notice by email prior to delivery of order.
Warranty Disclaimer and Liability Exclusion and Limitation Clauses
Books listed online and in Aquarius Press print catalogs are listed "as is" and "as available". Regardless of the nature of the claim or the reasons for any loss/damages, Aquarius Press's liability is limited to foreseeable and typical damages. AQP will not under any circumstances be liable to buyers and sellers for loss of use, loss of production, loss of income or profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the use of this website by buyer or seller.
In no event will Aquarius Press's total liability to buyer and sellers for any claims, proceedings, liabilities, obligations, damages, losses and costs, whether in contract, tort, or under any other theory of law or equity, and regardless of any negligence or other fault or wrongdoing by Aquarius Press or any person for whom Aquarius Press is responsible, exceed the lesser of US$25 or the purchase price of the item that is the subject of the claim.
The warranty disclaimer and liability exclusion and limitation clauses survive indefinitely after the termination of these terms and conditions.
Legal Claims
For all disputes between Aquarius Press and buyers and/or sellers arising from, connected with or relating to the website, the relevant parties will attempt to find a reasonable solution least onerous to the parties involved. If a dispute cannot be resolved by the parties, then the dispute must be resolved before the US court which has jurisdiction.
Changes to Website
Aquarius Press may, in its discretion, change, suspend or terminate, temporarily or permanently, the website or any part of it at any time, for any reason, without any notice or liability to buyers and sellers. Aquarius Press may, in its own discretion, change, supplement or amend its policies, procedures, terms and conditions as they relate to future use of the website from time to time without any notice or liability to buyers and sellers, by posting revised documents on the website. Buyers and sellers may not change, supplement, or amend these terms and conditions or any Aquarius Press policies or procedures. Prices are subject to change without notice. All prices are in U.S. dollars.
